Coach Eve Webber / Formula F.I.T.T., LLC — Terms of Service and Waiver

These Terms of Service (“Terms”) govern your use of all services, coaching programs, digital products, and other offerings provided under the brand “Coach Eve Webber,” which is a service offering operated by Formula F.I.T.T., LLC, a California Limited Liability Company. By purchasing a product or engaging with the services, you agree to these Terms.

1. Services Provided

Coach Eve Webber offers functional health, wellness, mindset, and faith-based coaching programs virtually. These services may include educational courses, downloadable resources, self-paced programs, video content, and/or group or individual virtual coaching.

These offerings are not intended to diagnose, treat, cure, or prevent any medical condition and are not a substitute for individualized medical care or mental health counseling. All services are delivered virtually or in-person.

All services are operated under Formula F.I.T.T., LLC and managed by Coach Eve Webber, Evelyn Webber.

2. Payment & Refund Policy

• All payments are final and non-refundable after 48 hours, except as outlined below.
• Digital content, online programs, and virtual coaching services are strictly non-refundable once accessed, due to immediate delivery of protected intellectual property.
• Discounted or promotional items are FINAL SALE and are not eligible for refunds under any circumstances.
• Refunds may be considered only in documented emergency situations (e.g., hospitalization, military deployment, or death of an immediate family member). Proof must be provided, and any refund granted will be at the sole discretion of Formula F.I.T.T., LLC.
• Subscription-based services auto-renew unless canceled at least 30 days in advance via written notice. No prorated refunds will be provided for unused time.
• By purchasing, you acknowledge and agree that you will receive immediate access to digital materials and waive any rights to a refund once content is accessed.
• Refund requests due to dissatisfaction, scheduling issues, personal conflicts, or change of preference will not be honored.
• Initiating a chargeback or credit card dispute after agreeing to these terms may result in legal action and removal from all services and platforms.

3. Health & Medical Disclaimer

Formula F.I.T.T., LLC and Coach Eve Webber, Evelyn Webber, do not provide medical advice, diagnosis, treatment, or mental health counseling. Services are intended for educational and informational purposes only.

You affirm that you have consulted with your licensed medical provider and have been cleared to make dietary, fitness, and lifestyle changes. You are solely responsible for monitoring your own physical and emotional well-being. The use of any recommendations or techniques is strictly voluntary and at your own risk.

4. Assumption of Risk & Waiver of Liability

You understand that health and lifestyle changes may carry risk. You agree to assume full responsibility for your participation and any outcomes that result from your use of the services or materials provided.

You voluntarily release, waive, and hold harmless Formula F.I.T.T. LLC, Coach Eve Webber, Evelyn Webber, and any employees, contractors, partners, or affiliates from all liability, claims, or demands related to your participation. This waiver includes any injury, illness, emotional distress, or damages that may arise from engagement with any services.

5. Technology Access

You are responsible for having the appropriate device, internet connection, and software to access the digital materials and coaching platforms. Formula F.I.T.T., LLC is not responsible for your inability to access services due to technical issues on your side.

6. Intellectual Property

All content, including but not limited to videos, guides, PDFs, curriculum, coaching tools, and online resources, is the exclusive property of Formula F.I.T.T., LLC and/or Coach Eve Webber/Evelyn Webber. You may not copy, reproduce, sell, teach, distribute, or publicly share any materials without prior written permission.

Unauthorized sharing or replication of content may result in legal action and immediate removal from all services without refund.

7. Jurisdiction & Governing Law

This Agreement shall be governed and interpreted in accordance with the laws of the State of California, regardless of the user’s location at the time of purchase or service delivery.

All claims, disputes, or legal actions must be resolved exclusively in the courts of Placer County, California. You waive the right to bring claims in any other jurisdiction or as part of a class action.

8. Terms Acceptance

By purchasing a product, enrolling in a coaching program, or accessing digital content from Coach Eve Webber, Evelyn Webber, you affirm that:

• You have read and agree to these Terms of Service and Waiver;
• You understand that all services are virtual and educational in nature;
• You accept all personal responsibility for your health, decisions, and results;
